James Fitzjames Stephen y el campo semántico de la codificación en la Inglaterra victoriana

James Fitzjames Stephen es conocido en la historia jurídica inglesa por su fallido proyecto de Código Penal debatido en el parlamento entre 1878 y 1883. Aunque las vicisitudes políticas y jurídicas de aquel han sido ya documentadas, dando lugar a un relato típico en la historiografía de la codificación, el concepto de código que yacía bajo el proyecto de Stephen aún no ha sido estudiado específicamente. Adoptando el punto de vista de la evolución del campo semántico del código en la historia del movimiento codificador en Inglaterra en el siglo XIX, se reconstruirá la noción de código de Stephen, quien recuperó la oposición semántica de esta al common law propia del planteamiento benthamiano sin, al mismo tiempo, renunciar al derecho jurisprudencial.
