Early and forced marriage as a form of violence against women: From Rome to the digital age

Abstract

In this paper, we will analyse the problem, from a diachronic perspective, of the phenomenon of early marriages, which involve discrimination against women and girls who, due to a series of adverse customs of a social and religious nature, place them in a subordinate role to men, attributing to women stereotypes far removed from the digital age society, although there is a supranational regulatory framework which has been implemented to fight against this type of marriages. This issue is also linked to Roman law and the situation of nondum minors, whose unions, although not legal, induced a series of patrimonial effects that are the analysis goal, together with the Roman tradition of the age of marriage and the subsequent repeal of the fourteen-year dispensation made by the voluntary jurisdiction law act 15/2015.
