Abstract

The article shows how some legal institutions like the cessio bonorum emerged with the reception of the ius commune. The cessio bonorum reveals the miserable benefit that entailed the cession of property that was granted to debtors as a way to avoid imprisonment. Glossators and commentators analyzed and systematize this Roman law institution as never had been done.
